The National Copyright Administration of the PRC (NCAC) plans to introduce a black list system to help crack down on online copyright infringement.
There are various pieces of legislation and regulations prohibiting online copyright infringement. Under the Measures for Managing Internet Information Services(
互联网信息管理办法
), commercial internet information services providers need to apply for a licence, whereas non-commercial internet information services providers need to report their services for the official record. The Measures provides that internet information services providers shall not produce, reproduce, release or disseminate information that infringes others' legitimate rights. Any person in violation will be penalized according to the relevant laws. In addition, commercial internet information services providers will be ordered to suspend their operations or their operating licences will be revoked. For non-commercial internet information services providers, the authorities that keep their records will order them to shut down their websites temporarily or permanently.
Despite these provisions, repeated online infringements are common. Some pirates do not even bother to change the domain names and simply continue their infringing acts using the same websites. A representative of the NCAC recently said that an effective way to get rid of this type of infringement is to build up a black list system and the copyright administrative authority will cooperate closely with the telecommunication authorities. If necessary, those websites found to be involved in repeated infringement will be shut down.
As the black list system has not been implemented, it is yet to be seen if it will be an effective measure.
